Terms & Conditions
These Terms & Conditions apply when you book a place on A New Way to Thrive – The Living Rhythm™ Mastermind.
Please read these terms carefully before booking. By purchasing a place on the programme, you agree to these terms.
These terms are between you and James Porter, a sole trader trading as Genivo International, of 15a Stonehouse Lane, Bath, BA2 5DW.

1. Programme overview
A New Way to Thrive – The Living Rhythm™ Mastermind is a 7-week live group mastermind delivered via Zoom.
The programme is designed for high-performing leaders who want to redesign their life into one that works. It is based on James Porter’s own ideas, reflections, life experience, educational content and personal-development framework.
The programme is for adults aged 18 or over only.
The Living Rhythm™ is an unregistered brand mark used by James Porter / Genivo International.
2. What is included
Your purchase includes:
7 live Zoom group mastermind sessions;
one digital copy of the accompanying eBook;
relevant worksheets;
reflection exercises;
preparation materials;
homework and follow-up emails;
access to session recordings, subject to the recording terms below;
access to a private WhatsApp or Telegram community during the programme;
reasonable email support during the programme;
reasonable WhatsApp or Telegram support during the programme;
any bonus materials that Genivo International chooses to provide.
Each live session will last approximately 90 minutes.
Programme dates, times, Zoom links and access details will be provided before purchase and/or in your onboarding email.
The private community and email support are available during the 7-week programme only. The private community will close after the programme ends.
Email and community support are not 24/7 support. Genivo International will respond within a reasonable time.
3. Access to materials
Programme materials, resources and recordings will be hosted via Google Drive or another suitable platform chosen by Genivo International.
Downloadable worksheets and programme materials will be available until the end of the programme. You are responsible for downloading any materials you wish to keep before access ends.
Session recordings will be available until 3 months after the final live session, unless a recording is withheld for privacy, confidentiality, safeguarding or other reasonable reasons.
Recordings will be deleted 3 months after the mastermind ends.
The eBook is provided as a PDF unless another format, such as EPUB, is requested and available. Once supplied and retained under these terms, the eBook is yours to keep for your own personal use only.
For clarity, this programme does not include indefinite or lifetime access to recordings, the private community, email support, WhatsApp/Telegram support, worksheets or hosted programme materials.
4. Price and payment
The full programme price is £297.
No VAT is charged.
Payment is made through Stripe via the Genivo International website.
You may pay either:
£297 in full at the time of booking; or
by payment plan: £148.50 at booking and £148.50 one month later.
If you choose the payment plan, your place is confirmed once the first payment of £148.50 has been received, subject to acceptance onto the programme.
If a payment-plan instalment fails or becomes overdue, Genivo International will contact you by email. If payment remains outstanding for more than 5 days, Genivo International may suspend your access to live sessions, recordings, materials, community spaces and support until payment is brought up to date.
After the 14-day cancellation period has passed, payment-plan customers remain responsible for all instalments unless Genivo International agrees otherwise in writing or the law requires otherwise.
5. Application and booking
Places are limited to 15 participants.
You must apply for the programme before payment. If your application is accepted, you will be invited to book and pay.
Genivo International may refuse an application or booking if:
the programme is full;
Genivo International reasonably believes the programme is unsuitable for you;
you are under 18;
there is another reasonable reason not to accept the booking.
If payment has already been taken and Genivo International refuses your booking before confirmation or access, you will receive a refund.
Your place is for one participant only.
6. Attendance and participation
The programme is delivered live via Zoom.
This is a camera-on mastermind. Participants are expected to attend from a quiet space, free from distraction, with camera on where possible and microphone muted when not speaking.
Participants are expected to participate respectfully and take notes where appropriate.
First-name-only display names are permitted on Zoom.
If you miss a live session, you may access the recording where available. No one-to-one catch-up session is included.
No refund is given for missed sessions.
You are responsible for having suitable internet access, a suitable device, access to Zoom and any other technology needed to participate. Genivo International is not responsible for technical difficulties on your side.
Reasonable technical assistance may be provided by email, but Genivo International does not guarantee that all participant-side technical issues can be resolved.
7. Technical issues and rescheduling
If technical difficulties on Genivo International’s side prevent a session from being delivered and the issue cannot reasonably be rectified within 10 minutes, Genivo International may reschedule the affected session or provide an alternative arrangement at its discretion.
If a session needs to be rescheduled due to unforeseen circumstances, every effort will be made to reschedule it on a date that suits the majority of participants. A recording will be made available for those who cannot attend.
A refund will not normally be given for the rescheduling of a single session.
If Genivo International cancels the whole programme before it begins, you will receive a full refund.
If Genivo International postpones the programme start date, you may choose to attend on the new date or receive a refund.
Genivo International may make reasonable changes to session order, content, materials or delivery where necessary, provided the overall nature of the programme is not materially reduced.
8. Cancellations and refunds
If you purchase as a consumer, you have the right to cancel this contract within 14 days, starting the day after your booking is confirmed, without giving a reason.
To cancel, you must inform Genivo International by a clear statement, for example by emailing:

You may use the model cancellation form at the end of these terms, but you do not have to.
If you cancel within the 14-day cancellation period before the programme has started and before the eBook or other digital materials have been supplied, you will receive a full refund.
If the programme start date falls within your 14-day cancellation period and you request that the programme begins during that period, you agree that Genivo International may start providing the programme before the cancellation period has ended.
If you then cancel during the 14-day cancellation period after the programme has begun, Genivo International may deduct a proportionate amount from your refund to reflect the services, sessions, materials and digital content already provided.
If you cancel during the 14-day cancellation period after the eBook has been supplied to you, Genivo International may deduct £9.97 from your refund to reflect the value of the eBook, unless the law requires otherwise.
After the first live session has taken place, the eBook is included in the programme price and remains yours to keep for personal use only.
Once the 14-day cancellation period has expired, refunds are not normally available unless Genivo International is required to provide one by law or Genivo International cancels the programme.
If you join the programme late, the full programme price remains payable.
If you miss one or more sessions, no refund is given for missed sessions.
If you are removed from the programme for serious misconduct, breach of confidentiality, non-payment, misuse of materials or other serious breach of these terms, refunds will be considered fairly and in line with the services already provided and Genivo International’s legal obligations.
Nothing in these terms affects your statutory rights.
9. Deferrals and transfers
Your place is personal to you and may not be transferred to another person without Genivo International’s written permission.
Deferrals are not guaranteed and may be allowed at Genivo International’s discretion if requested in writing before the programme starts.
Any agreed deferral is limited to one future cohort only.
10. Recordings
All live sessions will be recorded.
Recordings may include participant names, images, voices, chat contributions and spoken contributions.
Recordings are made so that participants who cannot attend live, or who wish to revisit the material, can access the session.
Recordings will be shared privately with the programme cohort only.
Because this is a group mastermind and participants may need access to recordings, recording consent is a condition of taking part. If you do not consent to your name, image, voice and contributions appearing in private cohort recordings, you cannot join the programme.
In appropriate circumstances, Genivo International may permit exceptions to camera-on participation, but this is at Genivo International’s discretion.
Recordings must not be downloaded, copied, shared, posted online, sold, distributed or shown to anyone outside the programme cohort.
Recordings will be stored in Google Drive or another suitable platform and deleted 3 months after the programme ends.
Genivo International may withhold or edit a recording where reasonably necessary for privacy, confidentiality, safeguarding, legal, technical or other legitimate reasons.
11. Testimonials, quotes and marketing use
Genivo International will not use your name, image, video, voice, testimonial, quote or identifiable contribution for marketing purposes without your separate permission.
Audio or written contributions may be converted into text and used anonymously only with your separate permission.
If Genivo International asks to use a testimonial, quote or other contribution, permission will be requested case by case. Names and identifying details will be removed unless you expressly agree otherwise.
12. Confidentiality
This is a group coaching and educational environment. Participants may share personal experiences, reflections, challenges and private information.
You agree not to share, disclose or repeat personal stories, comments, identities, screenshots, chat messages or private information disclosed by other participants.
You may share your own experience of the programme publicly, provided you do not identify other participants or disclose anything private or confidential about them.
You must not take screenshots, make your own recordings, download recordings, copy chat messages or share group content without permission.
Confidentiality is expected from all participants. However, because this is a group setting, Genivo International cannot guarantee absolute confidentiality by other participants.
Confidentiality does not prevent you or Genivo International from disclosing information where required by law, for safeguarding reasons, to obtain professional advice, or where there is a serious risk of harm.
13. Participant behaviour
You agree to participate respectfully and not to behave in a way that is abusive, discriminatory, harassing, threatening, disruptive or unsafe.
Genivo International may remove a participant from a live session, community space or the programme if, in its reasonable opinion, the participant:
behaves abusively or disruptively;
harasses or discriminates against others;
breaches confidentiality;
records, downloads, shares or distributes programme content without permission;
shares programme materials without permission;
fails to pay an overdue instalment;
seriously disrupts the group environment;
otherwise breaches these terms.
Where appropriate, Genivo International will give a warning first. In serious cases, removal may be immediate.
Refunds following removal will be considered fairly, taking into account the reason for removal, the services already provided and Genivo International’s legal obligations.
14. Personal responsibility and wellbeing
The programme provides coaching, reflection, education, personal-development content and group discussion.
It is based on James Porter’s own ideas, reflections, life experience and educational framework.
The programme may involve emotional reflection, inner child work, gentle reflective breathwork, meditation and personal-development exercises.
The programme is not therapy, counselling, psychotherapy, medical treatment, diagnosis, crisis support, financial advice, legal advice or a substitute for professional support.
You remain responsible for your own decisions, actions, wellbeing, participation and results.
If you feel you need medical, psychological, therapeutic, legal, financial or other professional advice, you should seek support from a suitably qualified professional.
You should not take part in any exercise, reflection, breathwork, meditation or practice that feels unsafe, unsuitable or inappropriate for you.
If you are in crisis, at risk of harm, or require urgent support, this programme is not appropriate crisis support and you should contact emergency services or an appropriate crisis-support provider.
15. Results and no guarantees
Genivo International may describe possible outcomes, benefits or transformations connected with the programme.
However, personal-development outcomes vary from person to person.
No specific personal, emotional, financial, business, wellbeing, lifestyle, leadership or other result is promised or guaranteed.
Any transformation, change, implementation or result is your responsibility.
Testimonials, if used in future, are examples only and do not guarantee that you will experience the same or similar results.
16. Intellectual property
All programme materials, worksheets, recordings, eBook content, written content, frameworks, methods, exercises and resources are owned by James Porter, unless otherwise stated.
The Living Rhythm™ is a proprietary framework, method and brand mark used by James Porter / Genivo International.
Programme materials are provided for your personal use only.
You may download and print worksheets and materials for your own personal use.
You must not copy, reproduce, share, sell, distribute, teach, adapt, republish, licence or use the programme materials, eBook, recordings, framework or method with your own clients, students, team, family, business or audience without written permission from James Porter / Genivo International.
17. Private community
The programme may include access to a private WhatsApp or Telegram community.
Participation in the community is part of the group-learning experience.
The community is available during the 7-week programme only and will close after the programme ends.
The confidentiality, behaviour, intellectual-property and personal-responsibility terms apply to the private community as well as to live sessions.
Genivo International may remove a participant from the private community if they breach these terms or behave in a way that is inappropriate, disruptive or unsafe.
18. Emails
By joining the programme, you will receive programme-related emails, including onboarding information, Zoom links, preparation materials, homework, reminders, resources and follow-up materials.
These emails are part of delivering the programme you have purchased.
If you choose to receive wider marketing emails or newsletters from Genivo International, you must give separate optional consent. You can unsubscribe from marketing emails at any time.
19. Privacy
Genivo International will process your personal data in accordance with its privacy notice.

This may include processing your name, contact details, payment information, application information, Zoom participation data, community participation data, emails, and recordings of live sessions.
Recordings will be stored using Google Drive or another suitable platform and deleted 3 months after the programme ends.

Genivo International will try to resolve complaints informally and fairly.
21. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer living outside England and Wales, you may also have rights under the mandatory consumer laws of the country where you live.
